All Customers of EN Technologies Pte. Ltd. (“EN”, “we”, “us” or “ours”) services are subject to the terms and conditions contained in thisg Terms of Service (TOS) document. This Terms of Service (TOS) document is a legal contract between EN and the End Users that contains the rights, duties and obligations of EN and the End Users.
EN reserves the right to modify, update and/or materially change any of the terms and conditions cont- ained in this agreement without notice to customers. Any modifications are effective upon posting on EN Website ("Site"). Customers shall periodically review the Site for any changes.
3. Billing Cycle and Renewal
Billing cycle for all web hosting services may be Monthly, Quarterly, Semi-Annually, Annually, Biennially or Triennially and on pre-payment basis before start of each billing cycle term. All orders are processed and activated only after first payment is made.
Renewals will be billed and invoiced 5 - 7 days before end of current billing cycle.
4. Late Payment and Termination
Service will be interrupted on past due accounts after a 48 hours notification. Service interrupted for nonpayment is subject to an S$30 reconnect charge. All hosting account will be terminated after 7 days of nonpayment. Nonpayment for domain name renewal will be result in domain name termination and release back to public registration after grace period and redemption period. During redemption period, there will be a redemption fee ranging anywhere from $50 to $700 depending on the top level domain.
5. Price Change
EN reserves the right to change the listed price of our services and amount of resources given to each plans, services or solutions. Updated pricing will be reflected on our website http://www.en.com.sg/.
Acccounts with existing prepaid terms will not be affected by any price or resource change throughout the remaining terms.
Accounts with good account standing may not be affected by any price or resource change during renewal.
Domain Names and SSL purchase or renewal is excempted from the above and will be purchase or renewal at existing list price at time of order.
6. Customer Data Preservation
You are responsible for the preservation of all of your data and any other content that you use with the Services. Best practices include routine archiving of data. EN is not obligated to retain any data after the termination of your access to the Services for any reason.
7. Scheduled Maintenance and Downtime
EN will use commercially reasonably efforts to provide services 24 hours a day, 7 days a week. Subscriber acknowledges that from time to time the services may be inaccessible or inoperable for various reasons, including periodic maintenance procedures or upgrades ("Scheduled Downtime"); or service malfunctions, and causes beyond EN’s control or which are not reasonably foreseeable by EN, including the interruption or failure of telecommunications or digital transmission links, hostile network attacks, or network congestion or other failures. EN will provide at least 48 hours advance notice to the subscriber for Scheduled Downtimes, and will use commercially reasonable efforts to minimize any other disruption, inaccessibility and/or inoperability of its web servers. EN has no responsibility for downtime resulting from a user's actions.
8. Disclaimer Of Warranties
YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. SERVICES PROVIDED ARE ON AN “AS IS” AND “AS AVAILABLE” BASIS. ANY USE OF THE SERVICES IS DONE AT YOUR OWN RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR OTHER DEVICE OR LOSS OF DATA THAT RESULTS FROM USING THE SERVICES. EN MAKES NO, AND HERERBY EXPRESSLY DISCLAIMS (TO THE GREATEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW) ALL WARRANTIES, EXPRESS, IMPLIED OR OTHERWISE, ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, OR STATUTE, AS TO THE SERVICES OR ANY MATTER WHATSOEVER. IN PARTICULAR, ANY AND ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT ARE EXPRESSLY EXCLUDED. EN DOES NOT WARRANT THAT THE OPERATION OF THE SERVICES WILL BE COMPLETELY SECURE, ERROR FREE OR UNINTERRUPTED, OR THAT ALL ERRORS WILL BE CORRECTED. YOU ASSUME ALL RISK OF DELAYS OR INTERUPTIONS IN ACCESS TO OR USE OF THE SERVICES RESULTING FROM USE OF THE INTERNET AND/OR TELECOMMUNICATIONS TO ACCESS THE SERVICES, AND EN SHALL HAVE NO LIABILITY FOR ANY SUCH DELAYS OR INTERUPTION.
8. Limitation Of Damages Or Liability
UNDER NO CIRCUMSTANCES SHALL EN OR ITS AFFILIATES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES OF ANY KIND OR NATURE WHATSOEVER, OR FOR COST OF PROCURMENT OF SUBSITUTE SERVICES, ARISING OUT OF OR IN ANY WAY RELATED TO THIS TOS OR SERVICES PROVIDED. SUCH LIMITATION ON DAMAGES INCLUDES, BUT IS NOT LIMITED TO, LOST GOODWILL, LOST PROFITS, LOSS OF DATA OR SOFTWARE OR WORK STOPPAGE, REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BROUGHT, EVEN IF EN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE OR IF SUCH DAMAGE COULD HAVE BEEN REASONABLY FORESEEN, AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY EXCLUSIVE REMEDY PROVIDED IN THIS TOS. EN’S MAXIMUM LIABILITY FOR ANY DAMAGES ARISING OUT OF OR RELATED TO THIS TOS OR SERVICES PROVIDED, WHETHER BASED ON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, SHALL BE LIMITED TO THE AMOUNT YOU PAID TO EN DIRECTLY ATTRIBUTABLE TO EN SERVICES UNDER THIS TOS DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE FIRST EVENT GIVING RISE TO LIABILITY UNDER THIS TOS. EN SHALL HAVE NO LIABILITY OR RESPONSIBILITY FOR ANY CUSTOMER DATA OR THIRD PARTY SOFTWARE. THE FOREGOING LIMITATION OF LIABILITY IS INDEPENDENT OF, AND SHALL NOT BE DEEMED TO MODIFY EN’S OBLIGATION UNDER ANY EXCLUSIVE REMEDIES FOR BREACH OF WARRANTY SET FORTH IN THIS TOS.
